Terms and conditions - Healthy Homes Assessment Promotion

1. The promotion outlined in the terms below (the Promotion) is offered by Barfoot & Thompson Limited (Barfoot & Thompson). The Promotional Period starts on 1st July 2025 and expires on 30th September 2025. Barfoot & Thompson makes the following offer (the Offer) to Owners to accept during the Promotional Period.

2. The Offer is that Barfoot & Thompson will pay for the cost of a Healthy Homes Assessment of a Property subject to the terms set out below (Terms). A Healthy Homes Assessment means an assessment by a professional contractor arranged on behalf of the Owner by Barfoot & Thompson to identify what work, if any, is required at the Property so that the Property complies with the Healthy Homes Standards regulations (Assessment).

3. To qualify for the Offer, a Property must:

a. Be owned by a person over the age of 18 years old, a trust, investment company or other legal entity (Owner); and

b. Be a residential property located within the regions of Auckland, Northland and Bay of Plenty; and

c. At the date the PMA is signed, be vacant or owner-occupied and available to rent (currently tenanted properties are excluded); and

d. Not be currently managed by any Barfoot & Thompson branch at the date that the PMA is signed; and

e. Not have been previously under the management of another Barfoot & Thompson branch which has been terminated less than six months before the date that the  PMA is signed with another Barfoot & Thompson branch for that Property.

4. The Owner agrees that:

a. Barfoot & Thompson is acting as its agent only in relation to arranging a third party provider to complete the Assessment on the Owner’s behalf;

b. The Assessment will be provided to the Owner for their review and information and the Owner shall check the accuracy of the information contained therein;

c. Barfoot & Thompson makes no representations or warranties as to the accuracy or completeness of the Assessment and accepts no liability or responsibility for any    errors, omissions or inaccuracies in the Assessment, or for any consequences or losses arising from reliance on it.

d. The Owner will take all necessary steps to complete the work identified by the Assessment that is required to make the e. Property compliant with the Healthy Homes Standards regulations, which may include:

i. authorising Barfoot & Thompson to proceed with quotes for the compliance work to be completed, or

ii. arranging its own contractors to complete the work on the Owner’s behalf).

e. That a new tenancy cannot commence and tenants cannot move into the Property until any work recommended by the Assessment has been completed.

5. This Offer is:

a. available to owners of a Property who sign a Property Management Authority (PMA) within the Promotional Period with a Barfoot & Thompson branch to manage that Property;

b. applies only to an Assessment conducted within 30 days from the date of the PMA (if instructions are given to proceed with the assessment after 30 days from the date the PMA is signed, Barfoot & Thompson will charge a fee for arranging the inspection as per section 3 of the PMA);

c. subject to the terms of the PMA, which include without limitation:

i. the minimum term of the management being 12 months as per section 9 of the PMA;

ii. Barfoot & Thompson charging a minimum fee for its services in relation to the Property as per section 3 of the PMA - which is either, 8.5% plus GST all inclusive or no less than 7.5% plus GST plus a letting fee on all monies collected on the Owner’s behalf, and 8.5% plus GST or 7.5% plus GST on all repairs, maintenance and renovations arranged on the Owner’s behalf (including any work recommended by the Assessment to make the Property comply with the Healthy Homes standards regulations);

d. specific to the Property identified in the PMA only; and is

e. not available in conjunction with any other offer, promotion, discount, deal or special conditions agreed with Barfoot & Thompson, including without limitation any discount on Barfoot & Thompson’s fees in the PMA.

f. Not transferable or redeemable for cash or credit and cannot be applied towards other property management fees or services.

6. Barfoot & Thompson reserves the right to extend, cancel or amend these Terms at any time.

7. By accepting the Offer made in this Promotion, the Owner agrees to the above terms and conditions.
